The terms “we”, “us”, “our” and “Fortune and Glory” refer to Fortune and Glory International Limited. Fortune and Glory operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Fortune and Glory is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability (subject to New Zealand law).

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction (18 in New Zealand) and, if under that age, have parental/guardian consent for use.

You may need to provide accurate information (e.g., email, billing, shipping). You warrant all information is correct, current, and complete. You are responsible for account security and all activity under your account. Accounts are non-transferable.

SECTION 2 - OUR PRODUCTS

We aim for accurate product representations, but colors/appearance may vary due to device settings. We do not warrant exact matches to screen images.

Product descriptions may change without notice. We may discontinue products or limit quantities/regions at our discretion.

Goods supplied to consumers are subject to the Consumer Guarantees Act 1993 (CGA). Nothing in these Terms excludes, restricts, or modifies any rights or remedies under the CGA that cannot lawfully be excluded (including guarantees of acceptable quality, fitness for purpose, matching description, repair/replacement/refund remedies for failures).

SECTION 3 - ORDERS

Placing an order is an offer; we may accept or decline at our discretion. Orders are accepted upon confirmation and payment processing. Review orders carefully; cancellations may not be possible post-acceptance. We will notify you of changes/cancellations via provided contact details.

Purchases are subject to our Refund Policy, but consumer rights under the CGA apply (e.g., remedies for faulty goods).

You warrant purchases are for personal/household use, not commercial resale/export without permission.

SECTION 4 - PRICES AND BILLING

Prices/promotions may change without notice. Charged price is as at order placement (in confirmation email). Prices exclude taxes, shipping, customs unless stated.

Provide accurate payment/account info and update promptly. You warrant credit card details are valid/authorized, and charges will be honored (including taxes/shipping).

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates only; no guarantees. We are not liable for carrier delays, customs, or events beyond control. Title/risk passes to you upon transfer to carrier.

Delivery must comply with CGA (reasonable time, goods in good condition).

SECTION 6 - INTELLECTUAL PROPERTY

All content (trademarks, text, images, etc.) is owned by Fortune and Glory International Limited, affiliates, or licensors, protected by New Zealand and international laws.

You may use Services/content for personal, non-commercial purposes only. You must not: republish, sell, reproduce, duplicate, copy, redistribute, modify, or create derivatives without prior written consent.

SECTION 7 - USER COMMENTS / FEEDBACK

Parts of the Services may allow posting comments, feedback, reviews, etc. (“Feedback”). We do not pre-filter/endorse Feedback.

Feedback reflects the poster's views; we are not liable for it (to extent permitted by law).

We may monitor/remove Feedback that is unlawful, offensive, breaches Terms/IP rights, etc.

You warrant: you own rights to Feedback; it does not infringe third-party rights (copyright, privacy, etc.); no defamatory/unlawful content; no viruses/malware.

You grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, distribute Feedback.

SECTION 8 - OPTIONAL TOOLS / THIRD-PARTY LINKS

Third-party tools/links are “as is”; we have no control/responsibility. Use at your risk; review third-party terms.

We are not liable for third-party content, sites, purchases.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Fortune and Glory is powered by Shopify. Sales/purchases are directly with Fortune and Glory. Shopify is not responsible for transactions, products, or losses. You release Shopify from related claims.

SECTION 10 - PRIVACY POLICY

Personal information is subject to our Privacy Policy and Shopify’s Privacy Policy. By using Services, you acknowledge these.

SECTION 11 - COOKIES

We use cookies to improve functionality/user experience. By accessing the site, you agree to cookie use per our Privacy Policy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We may correct errors/omissions in pricing, descriptions, etc., without notice (including post-order).

SECTION 13 - PROHIBITED USES

Use Services lawfully only. Prohibited: unlawful acts, IP infringement, harassment, spam, viruses, impersonation, etc. We may terminate access for violations.

SECTION 14 - HYPERLINKING TO OUR CONTENT

Certain organizations (government, search engines, news, etc.) may link to our homepage without approval if non-deceptive and contextual.

Other requests require email approval. We may request link removal.

No iFrames without permission. No use of our logos/artwork without license.

SECTION 15 - TERMINATION

We may terminate access anytime. Surviving sections: IP, Feedback, Disclaimer, Liability, Indemnification, etc.

SECTION 16 - DISCLAIMER OF WARRANTIES

Services/products “as is/as available”. To fullest extent permitted by law (and subject to CGA), no warranties (express/implied) of merchantability, fitness, non-infringement, uninterrupted/error-free use.

Nothing limits CGA rights or liability for death/personal injury/fraud under applicable law.

SECTION 17 - LIMITATION OF LIABILITY

To fullest extent permitted by law (excluding CGA-mandated liability), we (including Shopify) are not liable for indirect/consequential damages (lost profits, data, etc.), even if advised.

SECTION 18 - INDEMNIFICATION

You indemnify us (and Shopify, or any of our partners) against claims/losses from your breach of Terms, law violation, or misuse of Services.

SECTION 19 - SEVERABILITY / WAIVER / ENTIRE AGREEMENT

Unenforceable provisions severed; remainder valid. No waiver unless written. These Terms + policies = entire agreement.

SECTION 20 - ASSIGNMENT

You may not assign without consent; we may without notice.

SECTION 21 - GOVERNING LAW

Governed by New Zealand law. Disputes subject to New Zealand courts' exclusive jurisdiction.

SECTION 22 - CHANGES TO TERMS

We may update Terms; continued use = acceptance. Check periodically; material changes notified per law.
